The Poplars – Terms and Conditions
These Terms and Conditions shall apply to the use of the facilities and services provided by Cyridella Limited trading as The Poplars, of 33 Cross Street, Moulton, Northampton, NN3 7RZ by its customers and guests.
1. Definitions and Interpretation
In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Customer” means you, a guest of The Poplars;
“The Poplars” means us, The Poplars;
“Rates” means the prices payable for rooms and (where applicable) other facilities offered by the Hotel; and
“Website” means www.thepoplarsmoulton.com.
Unless the context otherwise requires, each reference to “these Terms and Conditions” is a reference to these Terms and Conditions and a Clause or sub-Clause is a reference to a Clause of these Terms and Conditions.
The headings used in these Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions.
2. Bookings and Reservations
Reservations may be made in advance through our Website, in person, by email or telephone. At this time, we will require certain information from you including, but not limited to, your name, address, contact telephone number and email address.
Payment details will be required for all reservations, however, no payment will be taken until check-in as detailed below.
Reservations booked in advance do not constitute a legally binding contract between the Hotel and the Customer until we confirm the reservation with you.
Reservations may be changed by the Customer at any time prior to arrival (subject to the cancellation provisions set out in Clause 4 below). We will use all reasonable endeavours to accommodate any changes requested but give no guarantee that all changes can be accommodated.
Reservations are not required. It may be possible to book accommodation on arrival, however we cannot guarantee the availability of rooms or other facilities for such bookings.
Customers may request additional nights at The Poplars at any time during their stay. We will use all reasonable endeavours to accommodate such requests but cannot guarantee this will be possible.
3. Fees and Payment
Details of all Rates including any promotional Rates and other special offers are available on our Website.
Rates quoted apply to accommodation only unless otherwise stated. Additional charges may apply for items such as meals and room service.
Customers shall pay all sums due upon checking-in to The Poplars. Payment must be made immediately, subject to any alternative agreement between the The Poplars and the Customer.
We may from time to time offer promotional Rates. In this event, any additional nights requested by the Customer shall be charged at our standard Rate.
We accept payment in cash (pounds sterling only) or by credit or debit card. We do not accept American Express.
4. Cancellations
Reservations may be cancelled without charge provided the Customer gives at least 48 hours’ notice of the cancellation before 9am of the check-in date for their reservation.
Failure to provide the required notice of cancellation shall result in the Customer being charged for the entire duration of their stay as stated in their reservation, at the Rate specified therein. Any such payment shall be taken immediately using the payment details provided by the Customer when making their reservation.
We may, from time to time, have to cancel a reservation. In this event, we will inform you immediately and will endeavour to find an alternative arrangement where possible.
5. Check-in and Check-out
Check-in time at The Poplars is between 3pm and 9.00pm. Check-out time Mon – Fri is between 7am and 10.30am and Sat & Sun is between 7 am and 11.30 am. Later check-out times may be possible by prior arrangement (and at our discretion), however in the absence of such prior arrangement, failure to check-out by 10.30am may result in the Customer being charged for an additional night’s accommodation at the standard applicable Rate.
6. House Rules
Customers are required to conduct themselves in a reasonable and responsible manner at all times when on The Poplars’ property and must not act in any which may disturb other guests. Failure to adhere to this requirement may result in a Customer being asked to leave The Poplars, in which case all sums due shall become immediately payable.
Smoking is not permitted in any rooms or any indoor public areas of The Poplars. Failure to adhere to this shall result in the Customer being charged an immediate fine of £200 and also for any and all costs incurred by us in cleaning the room (including fixtures, fittings and soft furnishings) and restoring it to a smoke-free environment.
Dogs are usually allowed in The Poplars and permitted in the one accommodation room, – details are available on direct request only.
Children under the age of 16 may not stay at The Poplars unless accompanied by an adult aged at least 18.
Customers shall be charged for any and all damage caused by them to any property during their stay.
7. Food and Drink
Unless expressly indicated otherwise, food and drinks are not included in any Rates quoted and will be charged for separately.
Please advise us prior to arrival if you have any special dietary requirements. We will use all reasonable endeavours to accommodate such requirements.
8. Car Parking Facilities
Car parking facilities are provided for Customers. Customers are required to provide their vehicle’s registration number on arrival.
We accept no liability for any loss or damage which may result from a Customer’s use of the car parking facilities. All such use is at Customers’ own risk.
The availability of parking spaces cannot be guaranteed. Parking spaces are available on a first-come-first-served basis.
Additional free parking is available in the local village which is an approximate 5 minute walk from The Poplars. The limitations of liability in this clause apply equally to the free parking in the local village.
9. Disabled Customers
We can provide assistance with access to The Poplars for disabled Customers. Please advise us of any special requirements relating to any disability prior to booking and arrival.
10. Limitation of Liability
To the fullest extent permissible by law, our liability for any loss or damage suffered by Customers shall be limited to that which arises out of the negligence of our employees, subcontractors or agents.
Notwithstanding the above, we shall not be liable for any indirect loss or damage which may be suffered by a Customer including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data or loss of enjoyment.
Nothing in these Terms and Conditions purports to limit or exclude our liability for death or personal injury cased by our negligence, or that of our employees, subcontractors or agents; fraud or fraudulent misrepresentation; or any other matter for which it would be illegal for us to limit or exclude our liability.
11. General
The Customer’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Terms and Conditions.
We may, from time to time, change these Terms and Conditions without notice, however we will use our reasonable endeavours to inform Customers as soon as is reasonably possible of any such changes.
12. Data Protection
We will not share your personal data with any third parties for any reasons without your prior consent. Such data will only be collected, processed and held in accordance with our rights and obligations arising under the provisions and principles of the Data Protection Act 1998.
13. No Waiver
No failure by us to enforce any provision in these Terms and Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Terms and Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
14. Severance
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
15. Law and Jurisdiction
These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.
Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
